Major Health Insurers Opt Out of CA's State-Run Market
Millions of Californians could face higher health insurance premiums next year after some of the nation's most prominent health insurers refused to sign up for California's new state-run health insurance exchange.
The move could signal a rocky road ahead for the national rollout of expanded health coverage under Obamacare.
According to The Los Angeles Times, UnitedHealth, the nation's largest private insurer, Aetna, and Cigna all are opting out of Covered California, the state insurance exchange, which announced Thursday morning the winning bidders and their proposed rates and plans for as many as 5 million people shopping for coverage next year.
The goal of the exchange is to offer individuals and small businesses a choice of private health plans similar to those that workers at large companies already receive. But with fewer insurers participating, some argue that individuals will face significantly higher premiums and fewer choices.

In 2010, Stockton had an unemployment rate of 18.4%, among the worst in the nation for large cities. In 2011, the labor market worsened and unemployment rose to 20.2%, well more than double the national average of 8.9% and the highest of any of the cities on this list. Violent crime rates also have worsened, increasing from 13.8 crimes per 1,000 people in 2010.

Facebook falls to half of public offering price

The stock dipped 87 cents, or 4%, to briefly hit $19, just minutes before it closed the trading day at $19.05. Facebook's shares ended the week down nearly 13%.
Facebook (FB) hit the $19 milestone a day after the expiration of a lock-up period that had previously prevented some early investors and insiders from selling their shares. Stakeholders who owned a combined 271 million Facebook shares before Thursday can now sell their holdings.
A breakdown of just how many major Facebook Inc. shareholders sold their stock this week won't be available until next week at the earliest, when sellers must disclose such transactions.
Facebook's stock has struggled since the company's mid-May IPO. It closed its first day of trading barely above its initial offering price of $38. It has been below that level since.
The stock has been down on 38 trading days, up on 25 days and unchanged on one since its initial public offering.
Investors have been concerned about the social network's ability to increase revenue and make money from its growing mobile audience. Many analysts, however, hold positive opinions of the company's long-term prospects.

Obama's Eligibility Still in Question
Evens the “ch’mos” who were in Fort Leavenworth with Lt. Col. Terry Lakin, the military physician who was court-martialed for refusing orders because he could not get confirmed Barack Obama’s eligibility to be commander in chief, recognized that Obama’s release of a Hawaiian birth document last year didn’t resolve the question.
That’s according to Lakin’s new book, “Officer’s Oath: Why my Vow to Defend the Constitution Demanded that I Sacrifice my Career.”
The just-released book explains what happened in his case, and more significantly, why.
The officer had served with distinction, but decided that based on the available information, he had questions about whether Obama is eligible to be commander-in-chief of the U.S. military and order soldiers into war.
He had tried for years to obtain confirmation through the channels inside the military, through his congressional representatives, and other available channels, to no avail.
So he decided that his oath of allegiance to the Constitution required him to refuse an order from the chain of command headed by Obama. That would, he thought, force the issue, and possibly get an answer.
He got an answer, but not to the question: He was court-martialed and removed from the military. He now has joined a civilian physicians’ practice where he sees patients daily.

In his book, he relates that he was in Leavenworth serving what amounted to a 5-month sentence when Obama released the document he represented as a copy of his original Hawaiian birth documentation.
That’s the document that Maricopa County, Ariz., Sheriff Joe Arpaio’s investigators have concluded likely is a forgery.
But other prisoners called his attention to the news report about Obama’s action and comments, and then asked him.
“One question, Terry.”
“Shoot.”
“All you were asking for was a birth certificate, correct? If Obama had nothing to hide, how come he didn’t release it a long time ago?”
“I guess what they say is right: no one knows a con job better than a convict,” Lakin wrote.
He addresses his case in chapters titled, “Of Paramount Importance,” “The Truth Matters,” “Doing What is Right,” “Crossing the line,” “Duty, Honor, Country,” and “Walking Righteous.”
The episode with the question from one of the “ch’mos,” (child molesters) comes in the chapter titled 27 April 2011, the date Obama released the document and posted it on the White House website.
Lakin notes that Obama claimed to have “had every official in Hawaii … confirm that, yes, in fact, I was born in Hawaii.”
“‘Every official in Hawaii’? I guess the president did not consult with Tim Adams. During the 2008 election cycle Adams served as senior elections clerk for the city and county of Honolulu,” Lakin wrote.
Adams stated that, “There is no hospital record of his birth in Honolulu … and the Hawaii Department of Health told us in the Elections Office that there was no birth certificate.”

GOP Rep. Tells Constituent Who Asks About Raising The Minimum Wage To ‘Get A Job’
House Democrats earlier this month proposed increasing the federal minimum wage to $10 an hour, which would catch the minimum wage up to the buying power it had in 1968. The proposal hasn’t gone anywhere, though, since Republicans who control the House of Representatives oppose any increase.
Asked by a constituent at a Fourth of July parade yesterday, Florida Rep. Bill Young (R) revealed that he is, predictably, opposed to the Democratic proposal. When a constituent asked him why he opposed boosting worker wages, Young replied simply, “Get a job“:
CONSTITUENT: Hi, I’m (inaudible) how are you? Happy Fourth of July. Jesse Jackson, Jr. is passing a bill around to increase the minimum wage to 10 bucks and hour. Do you support that?
YOUNG: Probably not.
CONSTITUENT: 10 bucks, that would give us a living wage.
YOUNG: How about getting a job?
CONSTITUENT: I do have one.
YOUNG: Well, then why do you want that benefit? Get a job.

Young seems to miss the point that the millions of minimum wage workers in this country already have jobs. What they want is a job that will pay them enough to actually live on, and Congress could afford them that “benefit” by making the minimum wage as strong as it was four decades ago.

Stockton, CA Filed for Bankruptcy, but What's Next?

(Reuters) - Stockton, California, became the largest city to file for bankruptcy in U.S. history on Thursday after years of fiscal mismanagement and a housing market crash left it unable to pay its workers, pensioners and bondholders.
The filing by the city of 300,000 people followed three months of confidential talks with its creditors aimed at averting bankruptcy.
"We are now a Chapter 9 debtor," Marc Levinson, the lawyer who filed the city's voluntary petition in the Eastern District of California, in Sacramento (Case 12-32118) told Reuters.
Pleadings in support of Stockton's eligibility for Chapter 9 bankruptcy will be filed on Friday, Levinson said.
Stockton, which officially declared insolvency and its desire to restructure its debt, also filed a separate list of its major unsecured creditors.
The California Public Employees' Retirement System, which manages Stockton's pension plan, tops the list. The retirement system has a $147.5 million claim for unfunded pension costs.
Other top creditors include investors holding $124.3 million of Stockton's pension obligation bonds, $40.4 million of the city's variable rate demand obligations, $35.1 million of the city's public facilities fees bonds and $31.6 million of the city's parking garage debt.
Wells Fargo Bank NA is listed as the trustee for the investors.
"We are extremely disappointed that we have been unable to avoid bankruptcy," Mayor Ann Johnston said in a statement. "This is what we must do to get our fiscal house in order and protect the safety and welfare of our citizens."
Negotiations with creditors ended on Monday with Stockton failing to win enough concessions to help close its budget shortfall for the fiscal year starting on July 1. The city will also file a motion to request permission to share information from the confidential mediation process.
HEALTHCARE TO BE PHASED OUT, PENSIONS UNCHANGED
The Chapter 9 bankruptcy filing, a rare event for U.S. municipal debt issuers, was left as the only option to close a deficit of $26 million in Stockton's budget for its the new fiscal year, according to city officials.
The budget approved on Tuesday by Stockton's city council suspends $10.2 million in debt payments and cuts employee compensation and retiree benefits by $11.2 million to help close the deficit.
About $7 million in savings would come from cutting retiree medical benefits for one year.
While the retiree medical benefits will eventually be eliminated, Stockton plans to leave its public pensions unchanged while in bankruptcy proceedings. Attempts to pare them would invite long and expensive challenges.
City Manager Bob Deis said he was out of options to balance the city's budget after deep cuts in recent years to Stockton's work force. City leaders rejected further cuts to the police department as Stockton is experiencing a surge in violent crime.
The city will maintain current levels of public services, although at the cost of Stockton shedding its retiree medical program and defaulting on more of its bonds, Deis told Reuters.
Stockton has already defaulted on about $2 million in debt since February, allowing the trustee for one of its bond insurers to seize a building once slated to be its future city hall and three parking garages.
"We need to spread the pain. What's left are creditors, our bondholders and retirees," Deis said.
Stockton has suffered a sharp drop in revenue since the collapse of its once red-hot housing market, forcing it to cut more than $90 million in spending in recent years.
The housing boom transformed the farming city into a distant bedroom community of the San Francisco Bay area, and the bust put it at, or near, the top of national foreclosure rankings in recent years.
Stockton becomes the nation's most populous city to file for Chapter 9 bankruptcy. But Jefferson County, Alabama, remains the biggest municipal bankruptcy in terms of debt outstanding, as it had a debt load exceeding $4 billion when it filed in 2011. Stockton has about $700 million in bond debt.
Standard & Poor's Ratings Services downgraded Stockton to default from selective default on Wednesday, citing the city's move toward bankruptcy and expectations that it will not substantially pay all of its obligations as they come due.
Moody's Investors Service on Wednesday cut to 'Caa3' various general fund-supported debts of the city, putting the ratings in the "substantial risk" category, one notch above the "may be in default, extremely speculative" grouping. Moody's said its move was based on Stockton's bankruptcy budget.

California's Stockton Opts to File for Bankruptcy
Only 13 cities, counties and other government entities filed for bankruptcy protection last year — the highest annual level in nearly two decades. Stockton, a river port of 290,000, was the seventh U.S. municipality to file this year and the first California city since Vallejo, which sought protection in 2008, according to James Spiotto, a Chicago bankruptcy attorney who tracks municipal bankruptcies.
"Filing bankruptcy is time-consuming, expensive and complicated," said Spiotto, noting that Vallejo spent millions of dollars alone on attorneys and other bankruptcy professionals. "And you never get the results you desire."
That's why experts are divided on whether other financially struggling cities, towns and other government entities will follow Stockton to bankruptcy court. Spiotto said it will be hard and expensive for Stockton to obtain financing.
Others say bankruptcy comes with non-monetary costs, too.
"Being in bankruptcy is decimating to your staff and morale," said Deborah Lauchner, Vallejo's finance director. "There's so much uncertainty. ... We've been taken apart and ripped by the seams and everybody examined us."
Since Congress added Chapter 9 to the bankruptcy code in 1937 to allow municipalities to seek protection, some 640 government entities have filed. Last year's 13 filings almost doubled the six filed in 2010. That was the most since an equal number were filed in 1994.
By comparison, roughly 1.5 million Americans file for personal bankruptcy a year while some 50,000 companies file for business bankruptcy.
"Bankruptcy is a huge drain on municipalities, because they have limited ways to create more revenue," said Los Angeles bankruptcy lawyer Karol Denniston.
Stockton City Manager Bob Deis said officials were left with little choice but to recommend bankruptcy after failing to hammer out finance agreements with creditors to address the city's $26 million budget shortfall.
"Unfortunately we have no comprehensive set of agreements with our creditors that would eliminate the deficit and avoid insolvency," Deis said at the City Council meeting Tuesday night. He said, however, that the city was still negotiating with some creditors and could reach deals with as many as one-third of them.
"We think Chapter 9 protection is the only choice left," Deis said. "If we get any agreements, those will be honored in Chapter 9."
The City Council on Tuesday voted 6-1 to adopt a special bankruptcy budget to address Stockton's $26 million shortfall if the city files for bankruptcy, as expected, by Friday.
The city has been hit hard by high crime and the collapse of the housing market in the past three years. It's also dealt with $90 million in deficits through a series of drastic cuts.
The new budget did not call for additional service cuts beyond those that earlier slashed the police force by one-fourth, the fire department by one-third and 40 percent of other city employees, along with wages and medical benefits.
The budget approved Tuesday night would suspend payments for debts and legal claims; reduce payments for retiree medical benefits; further cut some pay and benefits; and increase revenue through code enforcement and parking citations.
In standing room only chambers, former city employees told council members about their life-threatening medical conditions and said benefit cuts meant they would effectively lose their health insurance.
"For me, bankruptcy might as well be a life sentence," said Gary Jones, a retiree who used to be a police officer in Stockton and said he was diagnosed with a brain tumor.
Other residents complained about plummeting property values, and recurring break-ins and robberies.
"The average citizen will not put up with this. Their home prices have plummeted, they have no jobs, a lot of people are getting fed up so that they have to resort to crime." said Gregory Pitsch, a 22-year-old unemployed resident who made an unsuccessful run for mayor. "I'm asking you to make the right decision, not destroy the property values in this city, which bankruptcy will do."
But city officials said this Central Valley city in California's agricultural heartland has run out of options. In recent years, thousands of new homes mushroomed in Stockton, part of a suburban housing boom that attracted buyers from the San Francisco Bay Area and beyond. When the economy crashed and the construction bubble burst, Stockton was battered by foreclosures and lost income from property taxes and other fees.
Under bankruptcy protection, officials would retain power over day-to-day city operations and staffing, but a judge would take over all decisions concerning the city's debts, said Robert Benedetti, professor of political science at the University of the Pacific in Stockton.
The judge would decide which creditors should be paid, how much and in what order. He would make allowances for expenditures needed by the city to function, and it would be up to city officials to decide how to spend that money.
"One of reasons a city might want to go the bankruptcy route is that they don't want a situation where they have to pay out debts and have to close the police or fire department," Benedetti said. "Filing for Chapter 9 means you're asking the court to protect you against lawsuits from people who hold your debt.
"Bankruptcy won't take away Stockton's underlying financial problems, one of which is the economy, the high unemployment rate and the high foreclosure rate," he said. "It will take years for them to come out of this.""
If Stockton files for bankruptcy, it would be the largest city by population to do so, according to Spiotto, the Chicago bankruptcy lawyer who tracks filings. He said Bridgeport, Conn., is currently the largest city to file for bankruptcy, which it did in 1991.
Jefferson County in Alabama is the largest local government bankruptcy filing to date in terms of the size of its debt. It occurred in November 2011 and was followed by Orange County, Calif., in 1994.
Stockton was the first city to test a new state mediation law, Assembly Bill 506, which is less than six months old.
Under the law, municipalities considering bankruptcy must first negotiate behind closed doors with creditors for up to three months, with the goal of settling debts without filing for Chapter 9 protection.
Bankruptcy lawyer Denniston, who helped draft the bill, said legislators in other states are interested in how the mediation process could be used elsewhere.
"Nationwide, we're faced with a ton of municipal distress," Denniston said, noting dire economic conditions, massive foreclosures and future pension obligations. "It's the perfect storm."
