Expert sees potential in S.J. for businesses

STOCKTON - Revving up San Joaquin County's economic engine, particularly its existing transportation and distribution assets, was the focus Wednesday as area business development officials gathered to hear from an international logistics and site selection consultant.

Adam Wasserman, a principal of Global Logistics Development Partners of Scottsdale, Ariz., said the county was "an interesting location," at the fulcrum of the growing Central Valley and close to the Bay Area.

It has two major north-south freeways, two major railroad intermodal centers, Stockton Metropolitan Airport and the Port of Stockton.

"You sit on an inland waterway right here, and there are a lot of people very excited about the potential of what it can do," Wasserman said.

The pending opening of the marine highway, on which barges would shuttle container cargo between the Port of Oakland on the bay and inland ports in Stockton and West Sacramento, is a model for similar projects nationwide.

One now under study is the M5 Highway, a proposal to move cargo by ship along the West Coast instead of by truck along Interstate 5.

"The San Joaquin proposal is sort of a forerunner to that," Wasserman said.

But there are still many questions about whether marine shipping could compete with trucking and whether private investors will pay to find out.

"It's going to be tough," he said.

It took a federal transportation grant to underwrite the Stockton-Sacramento-Oakland marine highway project.

In addition, there are changes occurring in global transportation and challenges to overcome.

The U.S. lacks a coherent trade and transportation policy, particularly one aimed at bolstering economic growth instead of simply raising cargo volumes, Wasserman said. Such policies are a major focus, however, for trading nations from the Old World to emerging economies such as Vietnam, he said.

"They're outspending us; they're outthinking us," he said.

Another example is the Panama Canal expansion project, expected to double its capacity by 2014. It likely will redirect cargo from the ports of Los Angeles and Long Beach, in particular, to landings on the Gulf Coast, in Florida or even on the East Coast. Canada and Mexico, too, have designs on attracting cargo flows away from the United States.

It will take a continued effort for San Joaquin County to attract and accommodate new businesses in such a dynamic, global market, he said.

"You have a lot of the right ingredients, but it's not going to happen naturally," Wasserman said.

The global trade expert Wednesday toured parts of San Joaquin County and addressed a lunch meeting of the Business Team San Joaquin, a group organized by Fran Aguilera of San Joaquin County Worknet and Michael Ammann of the San Joaquin Partnership.

Team members include economic development officials from Stockton, Tracy, Lodi, Manteca and Lathrop, the county, the partnership and the Lodi Chamber of Commerce.

"We're trying to project this regionwide attunement to development," Ammann said.

On Tuesday, Wasserman was one of a half-dozen consultants addressing a forum in Sacramento organized by TeamCalifornia, a statewide group of economic development experts.

Gov. Brown's tax-the-rich pitch looks like a winner

Californians don’t actually hate taxes. They just don’t want to pay taxes.

Huh?

No, that’s not a contradiction. As my colleague Anthony York reported in Sunday’s Times:

California voters strongly support Gov. Jerry Brown's new proposal to increase the sales tax and raise levies on upper incomes to help raise money for schools and balance the state's budget, according to a new USC Dornsife/Los Angeles Times poll.

Sixty-four percent of those surveyed said they supported the governor's measure, which he hopes to place on the November ballot. It would hike the state sales tax by a quarter-cent per dollar for the next four years and create a graduated surcharge on incomes of more than $250,000 that would last seven years. A third of respondents opposed the measure.

Brown's new plan, rewritten recently amid pressure from liberal activist and union groups that had a competing proposal, relies on a larger share of revenue from upper-income earners than his original measure. Correspondingly, it leans less upon sales taxes, which are paid by all California consumers. The poll shows that taxing high earners is overwhelmingly popular.

You see: Californians aren’t opposed to tax increases — as long as it is someone else being taxed.

You want to raise my taxes? Over my dead body!

You want to raise taxes on the rich? As Oliver Twist might say, “More please.”

Or, as The Times story said:

"These poll results illustrate that Brown was very smart to put together this initiative the way he did," said Dan Schnur, director of the Jesse M. Unruh Institute of Politics at USC.

Well, yes. Go ahead with all those “Gov. Moonbeam” jokes if you want, but Brown is no dummy. The state needs money. Republicans in the Legislature act as if raising taxes violates one of the Ten Commandments. Californians believe, wrongly, that they are taxed to death (or rightly, that the Legislature needs to get a grip on how it spends tax dollars).

The solution? Pick on the rich. Because here’s what that strategy buys you:

Shirley Karns, 74, an independent voter from the Northern California town of Lakeport who backs the governor's new plan, said the wealthy should pay more.

"Those who have an unbelievable amount more than those who do not should contribute more," she said. "And on the sales tax, the more you buy, the more you pay. It's pretty tough on low-income people who have to pay an extra nickel here and there, but we've got to get the money from somewhere."

Shirley, we can safely assume, does not qualify for membership in the California millionaires club. (Nor, apparently, does she buy a lot of big-ticket items.)

Of course, these are just poll results. Poll results don’t matter as much as what happens when people step into that private little place called a voting booth. (See: L.A. Mayor Tom Bradley, governor’s race, 1982.)

But with the state’s education system crumbling, its infrastructure eroding and its budget bathed in red ink, a tax increase certainly appears to be at least one part of the solution.

And here’s betting that most Californians will agree in November — especially if they’re not the ones who’ll feel the pain.

California Court of Appeals Hears Facebook Privacy Case

SACRAMENTO—
Attorneys made arguments before a three judge panel today in Sacramento on whether postings on Facebook are constitutionally protected.

The case involves a jury foreman on a case in which five men were convicted in a gang beating. That juror posted observations during jury deliberations, which were seen by another juror on the trial that he befriended on Facebook.

During a court hearing in which the juror was given immunity, he admitted to the posts, one of which he said the proceedings were "boring."

Facebook refused to comply with a subpoena seeking his posts, and another court ruled that a subpoena of the information from the juror's attorney was “overbroad." The trial judge then ordered the juror himself to turn over the posts.

The juror's attorney, FOX40 legal analyst Ken Rosenfeld, argued the Stored Communications Act protects online communications on social media sites like Facebook. He also asserted that the request by the judge was a violation of First and Fourth Amendment rights to free speech and privacy.

When Rosenfeld was asked by one justice if the federal law even applied because Facebook was not forced to turn over the material, he contended that the law applies both to Facebook and the individual using it.

"We have to have a fair system in which jurors can feel comfortable knowing that their private lives are not going to be intruded upon in reaching verdicts and making decisions," Rosenfeld told FOX40.

But attorneys for the five men who were convicted say their clients also have a constitutional right to a fair trial. They say the juror disregarded daily instructions not to communicate anything about the case and there was other evidence that he acted to prejudice the decision. Justice Louis Mauro asked if there shouldn't be some balance in the rights of the juror and those of the defendants.

When are Police Gonna Stick to the Script

Stockton, California. What a place to live. That is if your not bothered by the drive by shootings, police brutality, and corruption in the city's foundation. I tend to ignore everything that is not an immediate threat to my livelihood, because I've been through a couple of odd run ins with the Stockton Police Department, and let me tell you, these were not protectors of the public. The things along my own journey that blessed me with enough patience to deal with the bullshit I've had happen to me while living in "The All-American City."

Just recently, I had gone out one night with a friend of mine, well I thought he was a friend. We went to a buddy's of his Auto Shop to talk business. After we pounded a couple of adult beverages, several hours had passed, and now the three of us rode to another friends of his house. At this lady's house we continued to discuss business, in relation to investing in a few of my new start-ups. My buddy Alex tries getting me to drive him home before 2am, otherwise it's all bad for him being that he lives at his parents house still.

"I never drive after drinking, because unlike you, I learn from my mistakes," I told him because of his fifth DUI he received nearly two months prior.

This started an argument, that later turned physical. After defending myself for nearly 30 minutes, catching him off guard a few times with my own heavy hitters. Eventually we were both tired so I went and sat on the curb to catch a breath or two, when I was struck in the back of the head with either the handle of a pistol, or a flat square-ish rock, possibly even a brick and as a result I was knocked unconscious. Face down in the intersection just south of Downtown Stockton is where I laid for Several hours.

While I was out, Alex must have dug into my pockets, and took my keys as well as my wallet and cell phone. He then took my car in an attempt to beat his curfew. When he was driving towards his house, he totaled my car, and ditched it.

When I finally woke up, I was in the San Juaquin County Hospital with no shirt, no hat, no wallet, no phone, and later I found out I no longer had a car.

I walked home from the Hospital and asked my wife, if she drove me to the Hospital. Wow was she mad, furious with me for even leaving the night before, and not calling her all night. Well After I had explained to her the entire story she was more understanding about the missing car not being completely my fault. We had decided to call the Stockton Police Department and Report it Stolen. Several hours passed, before they located the car and called us. They told us where it was and that we had to come and tow it ourselves because it was on Private property.

We were stunned when we finally got to see it, complete disarray, all of my belongings were missing, there was no key, and we are talking about a 2003 All-road with a 2.7 L V6 Bi-Turbo engine, in optimal conditions this beast is boasting nearly 400 Horsepower. More than likely, since my thoughts resonated in my memory that he was the culprit, he was acting strange the whole night.

Later after we took care of the insurance, our insurance company, told us to get a copy of the report from the Police Departrment. When my wife called, they told her there was no report on file. No Report, yet they had record of our call to report the car stolen. So they sent a "sworn officer," to take a report. When the Stockton Police officer arrived, I greeted him, and politely started explaining to him what my issue was. After completing all of the above, the corrupted official told me, "Well, here is what's going to happen, nothing!" "What, why are you telling me nothing? Can you at least write us the report, so our Insurance company can make their diagnosis of the situation." I beckoned with reason. "No, no, no... because I don't feel that a crime has been committed." he said with conviction. "But it doesn't matter what you think, I am telling you facts, I am only asking that you put it into a report." I replied. "We are not going to do that, you got the call log, sorry!" And after he stated this he got into his car and drove off.

So you think I am Worthless?

In a scuffle of opinions, a friend mentioned that he thought my "attention was worthless." What does that even mean? I can focus my attention towards anything worthy of my time. The best part is who was telling me this. Someone who has two baby's from two baby mama's, who both stay with their folks because he still stays with his. Society will cast judgements, something I tend to steer clear of.

I appreciate the haters who keep my name circulating. It is because of you, most of my success is apparent to the rest of the world.

WESTCOAST DRY SPELL FINALLY BROUGHT TO AN END

It seems as though this winter could be looked at as odd, it makes perfect sense to co-relate to the planetary shifting of the poles. This could explain how we are experiencing the cold and Dry weather in the Central Valley. Usually we have a very wet winter, somehow I've noticed that this wet storm brings rain that will definately help us get closer to our Seasonal Lows.
